My mortgage is in dispute with the servicer because of a payoff that was processed and credited, and then reversed nearly a week later without remedy or return of the instrument. Documentation to verify the reversal has been requested on numerous occasions to prove that this money did not pay in or was reversed at a later date (I have an emailed copy of the back endorsements showing crediting to acct, bank routing number, etc. supplied by the payoff dept). None has been given. They are now threatening foreclosure (known for foreclosure fraud). Isn't a reversed payment supposed to be returned within 48 hrs (now it is 6 months later). Do I have legal recourse in court? State: NM.
