Can my husband sign the birth certificate of a baby he is having with another woman? Yes we are still married and the mother of the child would like to legally sign away her rights to him and I would step parent adopt. We live in Nebraska.

Yes, he can. He and the mother have to sign Voluntary Acknowledgment of Paternity.A father will be shown on the birth certificate only if he acknowledges paternity when or close in time to the birth, or the Court orders the birth certificate to be changed to reflect the Fathers name.
