Your parents will not get anywhere complaining to him directly, they need to speak with the principal, someone with actual authority over him.

Not in those words - why not?
Next time he leans in too close, stand up and say loudly 'You are too close and it bothers me.'
Leave out the smell of cigarettes, which isn't the main problem.

Smoking isn't illegal. It sounds like that's the main thing that's bothering you.
He's not smoking in the classroom, so there's nothing you can do about it. He has the right to smoke on his own time.

You find the fact that he smokes "uncomfortable and disturbing"?
How is he inappropriate other than the smoking, which isn't something he's legally obligated to change.

Yeah you may find it "uncomforable and disterbing" but that's just too bad. Either you work to get moved to a different classroom or put up with it.

I love that you didn't correct the spelling. I couldn't help it, therefore my quote really isn't accurate. Yours is. :)

You've done your part having your parents speak to him at their conference. If your school is like many, tobacco and drugs are forbidden on campus. So, if he does smoke anywhere on campus, including the parking lot, he could get in trouble. Have your parents try to speak with the principal or superintendent. That should get some type of investigation going. Let us know if it changes at all.
