We bought, & have occupied our home for 11yrs now. The house next door was empty, but was bought about 7yr's ago. When we bought our home, we did have a survey. We paid $6.800 for it, but we both had to work when it was done & came home to find boundary stakes in our yard. We didn't think anything of it. The home next door was sold to what I thought was a sweet older couple. I even cared for their yard each season as needed. Then one day I laid out tomato stakes,& they were gone. When I ask the neighbor if she knew where they were she had her son get them from her garage, and then had him throw them on my feet HARD! She was irate that I had pointed out the property line to her. She replied that "her realtor told her differently,& pointed to no area in general." So one day other neighbors had come to help us run a string from survey stake to survey stake. She came out of her house, & proceeded to my neighbor's property,& demanded to know "who's property this was!" To make a long story short at the end of the day,her son had hit me so hard in the chest I thought it was going to stop my heart.. she stood there & laughed... She then told me that if I called the police, she would say,"that I hit her,& he was defending her." Unbelivable... but she called the police on me that day & told them I was trespassing,& I was making a scene, & threatening her.. This our first home,& she owns many properties. We didn't know what to do? So we went on all the while staying off our property... Bc she would physically stand on it, or call the cops& say we were trespassing.. They would come out, and then it got to be where they wouldn't show up at all. They would tell her she needed to hire a attorney,& have a survey.. So then I decided to plant a barrier, & I used expensive several gal sized tall grass &planted it on us to allow it to grow w/o encroaching on her. In the meantime she had planted so many things on us, &it is all still there, because we aren't that kind of people that just mow over someone else's thing's. Then two days after I plant the grass she has a old man mow it down. The old man stood right beside her, and said, "Your all liars, you don't have a survey." and then he says" this woman had one!"' here come the sherrif she had called once again. Not even 10minutes later she is telling the cop,"I'm not paying for a survey!" and the old man was standing right next to her.. (older people talk about youth not having ethics,& morels please) so I mow few days later.. Here she comes, I told her,"to get the eff off my property,& stay off!" and then we hired a lawyer to send her a letter including she was to stop trespassing,& stop tearing up our SURVEYED PROPERTY!" she had the old man keep right on mowing like nothing. We hadn't mowed our yard, or been outside for 3 wks bc we were scared she would lie. What did she do? She went to the courthouse & filed a bunch of lies!!! Saying we were threatening her, and stalking her. Mind you the letter did tell her we were building a fence, & it would be under security cameras at all time's. Yet,she files charges to say this stuff, and prevents us from building a fence. She has never abided by our attorneys letter, but acted as if it didn't exist. So we go to court, and we don't have a criminal attorney, but her attorney says,"my client doesn't wish to make this a bad situation!" "she wishes it to be settled out of court." YEA BC SHE FOUND OUT WE HAD SECURITY CAMERAS,& SAVED LIKE 27,000 hours of footage. So that's why the neighbor crap.. So at first he wants is to sigh some agreement, we said nope. Then he says it were willing to pay 4 another survey then that would be great. We did,& it shows she her carport is halfway on our property. But, while we're at the courthouse, she says "she wants to keep her restraining order." we LAUGHED BC WE KNEW IT WAS BASED ON HER FANTASY!!! (woman is evil, and not one bit afraid to lie.) so we agree.. And her attorney makes a deal that except for the survey NO ONE IS TO DO ANYTHING, OR BE ON (OUR) THE CONTESTED PROPERTY. We agree bc she has kept us off it for two year's.. So we have our second survey, and come to find out that her house hadn't any surveys period!!! Since it was built!!! And we also find out that not only is the carport on us, but her houses drains,& there is electric ran to our home also.(our electric bills are sky high,but we don't know it this is why) we have been having problems with erosion & our home slipping.. Her drains are draining at the top of our hill...right thru the center of our front yard.. The guy that built the house, then covered all this with on him with a concrete driveway. We have ask ppl that have lived around here for a long time,& were told he built the carport,& did the other things when this house was empty.. So anyway we made the deal in court with the exception for the survey, no one was to be on the property she is disputing. The very next day, they are mowing,& planting on it. So we file a motion for contempt & it's on the court docket that it's contempt then today it was gone., so I'm taking the surveilence footage tomorrow to the court & entering it on the record. Oh one more thing, the letter our attorney sent her to cease the trespass,& etc he also sent a copy to the local sheriff... Do we have any chance or hope from allowing this horrid lying woman from taking our property. It's quite a bit. And she has refused to get a survey, but called 911, filed charges on us for trespassing & etc. We did tell her nicely several times that it was ours, but we're met with "liar" and then they stand in their windows if we were outside trying to do any work at all. I mean we haven't been able to use or be on property for over two years now, that we are paying for & paying taxes on. Ps. We have camera footage of it all. She didn't know this until we went to court last time, think she thinks we're bluffing her.. We're not. We haven't has our neices stay with I'd once, because her son goes in their backyard & masterbates.. So this is what were rewarded with for being honest, and doing what we thought was right.. Please help
