18 - full legal age or earlier if you are emancipated (which is self supporting, educating with your OWN place to live).

Who has custody of you now? How old are you?
Bottom line, if you're under 18 either parent can petition the courts for custody. If you're a young teen you will certainly be allowed to voice who you prefer to live with, but that doesn't mean that you'll get your wish. The judge will be the one to decide who gets custody, or whether an already established custody agreement can be altered to partial custody.
I'm assuming your grandparents have custody. Why? There must be a reason why your father couldn't get custody of you. That reason may still stand.

My guess is he lives with his mother and wants to live with either his dad or his grandparents.
