View Full Version : How do I relinquish my parental rights in Illinois

I am a father that has a 11 year old and I would like to relinquish my parental rights over to his mother and the mother does not want me in is life. Yes I have done some bad things in the past. I didn't hurt him in any way. I regret doing the things I did. Like taking his V-Smile and selling it to someone else and that was the only thing that I did and the mother does not want me in his life. So it's been 11 years out of my son's life. Now my son's mother keeps telling me that my son does not want to see me any more and keeps asking to give up my rights and now it's to the point were I am willing to give up all my rights. How can I get started??

There is this myth that a parent can just relinquish their rights. But its only a myth. Only a court will terminate parental rights and courts are very reluctant to do so. Unless the mother remarries and wants her husband to adopt, it is highly unlikely that you can have your rights terminated.
You of course don't have to exercise your rights, which apparently you aren't. Why you gave up on your son I don't know. But tell the mother to stop wasting both of your time, its not going to happen.

What is the goal? You will still be responsible for child support.
You may relinquish your rights/ in the sense of not having legal and physical custody/ easy-you sign papers which allow her to be designated as SOLE / not soul/ custodian.

You are out of the child's life, so you got it. You don't call, don't go see, just disappear from the child's life, and the mother has what she wants.
You can not sign over your rights, unless she is remarried with someone wanting to adopt.

She never married and she is telling me to sign over my rights and Im willing to but I just don't know how to start the whole proses. I would like to know how, where to go and what is the fastest way. She wants me to sign over to her but does she have to go to the courts and get it or do I??

Did you read your previous answers? She can tell you whatever she wants. You can sign whatever you want. ONLY a court can terminate parental rights and courts are very reluctant to do so. This is not going to happen!
Again, what do you or she think terminating your rights will accomplish anyway?

Tell her fine, tell her to hire an attorney and that you will sign a paper that can go to the court for this.
There is no fast way, even if posible, it has to go though the court.
