My guess would be "no" because the chances of such an issue making it to an appeal are virtually nil. I have never heard of such a by-law in the first place.

Seriously, I found that note-taking did aid retention, but I never kept the notes. The important part is the learning going into the head, not on the notepad.

I tried recording the lectures, but that acually seemed to impede retention, for some reason. I think it had something to do with dulling the urgency of understanding what was being said at the moment it was said.
