View Full Version : Can I sue for a criminal recorded reported under my SSN?

I work for the federal government as a CSR. I was put under investigation, because a criminal record appear under my SSN, which is not mine. I have never been arrested. The investigation is not completed because of the back log the department has. My reputation has been tarnished along with emotional anguish. Because of the status I'm in I can not do my regular work and I have lost the opportunity to attend training and work overtime. Aside from the humiliation at work with my peers, this has caused loss of financial gain, emotional distress and emotional anguish, weight gain and high blood pressure. I have file a police report which is under investigation to get this cleared up. Can I sue the agency for eronously entering the record under the incorrect SSN?

And who exactly do you plan to sue, you may sue the criminal that did this if they are known. But normally a criminal does not have anything to get. So if the person who used it, was caught you may sue them for your actual damages.
