I have a situation where I still live in the home with the father of my 2 children. Also with the grandparents on the fathers side.. the father and I are no longer together in which makes the siutation dificult... there has been mulitiple times of physical abuse between my kids father and his own mother while arguing in front of my kids, and several times my kids where being held by their father at different times it has happened. And has been verbal abuse between myself and my kids father telling me every so often that I will never be with anyone else and if I do he will ruin any relationship or kill anyone I try to be with.. there are times the grandmother of my kids will threaten me saying she knows her rights as a grandmother and is very mulipitive when it comes to my children so I'm basically battling between two people my family lives a few states away in which I want to move back home with my boys where I know they will live a peaceful and safer environment I know many of you who read this are thinking I should've left a long time ago but I'm 25 and due to the situation I'm living in I don't have friends around to help because of the situation and I haven't seen my family in almost 7yrs because neither the father or the grandmother will let me go on my own due to the fact they are afraid I would never come back.. I. Really need information on what to do! I need to get out of the home for my boys and with my boys safely.. thank you

Also the father and I have never been married... he is on our 5 yr olds birthcertificate but he is not on our 1yr old birth certificate... by the father nor I ever being married what are my rights?

You have the right to file for primary custody. And move out of the house. If you try to leave the state the father can file for primary custody and force you or the children to return.

What you should do is find a support group for abused woman and talk to a counselor who can help you.
