View Full Version : Travelled on H1b only for total 108 days. Any refunds ?

Hi,

I travelled in Oct'11 for a 3 month project ending in Jan'12 on an H1B visa along with wife and 1 year old daughter.

Since on H1B, my Indian company paid me USD salary and also deducted taxes. Now I have received a form called W2.

Since I was on this short trip, do I need to file a return ? And, would I be eligible to get any refunds, rebate, exemption, etc. (basically would I get anything back?)

Yes, you do need to file a U.S. federal and probably a state income tax return. You will file Form 1040NR plus Form 2106 to claim your daily living expenses.

It is likely you will get all of the withheld federal INCOME taxes, but the FICA (Social Security and Medicare) taxes cannot be recovered.
