I'm 15 turning 16 in 14 days, I'm about 3 months pregnant. My boyfriend is 18, my mom has known about us dating for 8 months and she has even let him sleep over in my room in the same bed not even caring if the doors locked a dozen times while my step dad was gone on a business trip. My mom even knew we were having sex, she had told me a few days ago that if I get pregnant she was going to call the cops on him. I live in Illinois, can he got to jail even though my mom had know about me seeing him and having sex with him?

Age of consent in IL is 17. There is no close in age exception. But the penalties if the rapist (and he is a rapist), is less than 5 years older are less.

The purpose of age of consent laws is because minors are deemed unable to legally consent to sex. That also means that a parent can't legally consent either. If your mother allowed a boy (let alone an 18 year old) to sleep with her 15 yr old child, then she can also be prosecuted for endangering a child, but that doesn't let him off the hook.

So it may not be too smart for her to call the cops. But somewhere along the line, someone will note that you were raped and report it to the police.

Sorry to tell you this, but there is a strong possibility your boyfriend is going to jail with a lifetime tag of sex offender.

I'll be 16 in less than a month and I'm pregnant, my boyfriend is 18. How long can he typically be in jail for, and when he's out can he see me and our baby?

Excellent response from ScottGem. I was too upset to stay rational - both at the mother and at the young man.

There are thousands of couples in their 40s who can't have children. Would you consider the gift of your child as a contribution to the world? You can have another when you are older and financially able to provide. You can even be paid, if you find a private adoption agency.

Agree, boyfriend can go to prison for many years and be labeled a sex offender for the rest of his life and have to register when he gets out of prison.

Mom is likely to be charged if it can be proven she knew

15 year old is likely to end up in foster care if mon is put into jail, or at least for her own protection if this is proven.

Looking at the laws in Illinois, he may get up to a year in prison. Yes he will be able to see you and your child after he is out, if your parents allow it.

In Georgia, the sentence is about 5 to 10 years, I know one boy ( friend of my son) who got 8 years for his underage girl friend giving him oral sex.
He got out in 5 years. He had to get permission from his PO to see the child. He could not live or see the girl because she was the victim of the crime.
But of course he did go to see her and he is back in prison for violating his probation.

Have a look at the Illinois sexual assault laws and their sentences, the age is very important in the charge. In this particular case, it is up to one year. However, since it resulted in a pregnancy it could be substantially more, now that I think about it.

The likelihood is yes he will be allowed to see the child. But he will have to register as a sex offender and that will make it difficult for him to find work.

The two of you really screwed up your lives with the help of your mother. I don't know who acted more stupidly. Your mother for allowing him to date you (let alone sleep in your bed with you). Him for not understanding you are jail bait and engaging in sex. Or you for opening your legs to him.

And your almost turning 16 doesn't matter. Age of consent is 17.

Also like to add that you should probably start figuring out how you're going to tell your mother. From the sounds of it, you didn't. You're going to need some help through the pregnancy at that age.

Better tell her before your stomach does.

It doesn't matter that you are "turning 16 in 14 days," I don't understand why people say that. The fact is that you were 15 and an 18 year old boy raped you and your mother allowed it. Yes, he could, and should, go to jail and you could also go into foster care when you are taken away from your mother because she did not prevent this.

I think you mean because the mother allowed it. Its one thing to not prevent your child from getting pregnant. Even a conscientious and caring parent may get caught flatfooted. But to consciously allow her to date an 18 year old, to further allow that 18 yr old to spend the night in their house and, even further, to allow that 18 year old to share the daughter's bed? That is criminal neglect! I would not be surprised if the OP was taken from this mother and placed in Foster care.

If your mum calls the cops, she'll be jailed to for letting you have under-age sex.

My sister was 15 and her boyfriend(now husband) was 18 when she got pregnant with there now 5 year old daughter.. They had some legal actions but they told the officers that it only happened once and both sets of parents were there to help their case he didn't get into any trouble.. I know each case is different but that's what happened with them.. If your parents aren't trying to kill your baby daddy and his parents aren't trying to kill you and if they help you guys through this then maybe it won't be that bad... good luck...

Did you even read the post? She said her mother will call the cops on him if he gets her pregnant which he did. That means legal action will be taken, and people will be in big trouble.

I'd like to actually see a case where a 15 year old gets pregnant by an 18 and the police let it "slide" and he is not jailed. There must be some pretty loose laws on rape where you're from.

It sounds a bit farfetched that an 18 year old was not held legally responsible for molesting a 15 year old.

First you need to be more polite. Second, One does not have to live through something to know the law. In fact, giving advice based on a single personal experience is usually not valid.

I suspect what happened in your sister's case was that both parents agreed they would get married and that saved him from being prosecuted for rape. It doesn't matter how many times it happens, having sex with someone underage is illegal. Whether it is prosecuted or not depends on several factors.

Actually it doesn't sound that far fetched to me.Given close in age exceptions in many states and the fact that the mother and father married, I can understand it happening.

They didn't get married until last year so that's not what happened... All cases are different.. It just depends on the circumstances... So whatever...

Then he is lucky that the local prosecutors didn't prosecute. I don't know why they didn't, but he is lucky they didn't.
