View Full Version : Can my boyfriend's mother kick me out of her house?

My Boyfriends locked up for a hit and run. We have been living in his moms house for over a year, she gave me the impression she wasn't interested in his case so I rarely speak to her about what's going on with him. All she's ever asked me about him is "how is he doing" Natrually my response is: "hes ok, as good as he can be in jail", then usually that's the end of the conversation. She's never asked me specifically "what's going on with his case". Today I came home from visiting my boyfriend in jail, and his mother is all over me about why I never tell her what's going on with her son. I told her because she never asked me specifically what's going on, so I figured she didn't want to know (I was very calm and respectful and always have been twards her). She got in my face started yelling at me so I yelled back. I asked her to get out of my face and to leave me alone, she followed me around the house while I was looking for my phone, still yelling at me about god knows what, (I just tried to blank her out) I uttered to myself " I'm getting the out of here", and she threw a glass of water at me screaming that I was cursing at her. I started crying and screaming back at her. I ran to the phone and called the police. ("They never showed up"). While I waited for the police to show up she kept yelling and threatening to throw me out of the house. She called me a piece of , a fat (BTW she weighs like 240 or 260) we pushed and shoved each other, she kept calling me names so I called her names to. Eventually she went to her room and I went to mine. It's hours after the incident and no police? Can she throw me out? I pay her for what I use, I pay the con edison bill and give her $140 a week, and buy most of the food in the house, but all of the bills are in her name and the house belongs to her and her sister. I'm just renting out the attic. I don't use a t.v I have a tablet and a computer so that's my entertainment. I use the kitchen but I also cook for everyone who's here, "when I do cook".

Short answer is YES... she can evict you... its HER house after all not yours.

From my past experience from my ex-mother in law I can tell you its better to get your own place even though you put in money because she's always going to be down your throat and at your own place no one can tell you anything because you pay your rent. And she doesn't have the right to kick you out because you help out. Also tlk it out with your man an see what he tells you because you guys are a couple and she needs to respectr you are her son's girlfriend.

You are a tenant in her home. That means she can evict you according to the laws in your area. But she can't just throw you out or lock you out.

Would you PLEASE.. spell out your words... there are very clear rules on this site that prohibit Chatspeak on ALL its forums. I got a headache trying to read that.
And besides... Its the boyfriends mothers house... She was every right to evict her no matter if she pays ALL the bills or none of them. And the respect should be going to the Homeowner... be glad you were allowed to live there at all so far.
And she can do it in as little as 2 weeks in Florida.. but 30 days on average in most of the country.

Thanks. I've been saving up for a place of my own, but NY is sooooo exspensive and I have a little puppy so finding an apartment was really hard. I have $1,000 saved up right now but Tuesday I have to pay my lawyer $500 then Friday I get paid again. Most apartments want around $3,000 up front before moving in. It would be nice for my boyfriend to come home to his own place, and not be in his moms house. I will keep looking for apartments, I feel a little more hopeful.

Interesting - but this is a legal forum. What's your legal advice?
If you continue to use text speak on the legal thread your posts will be removed.
{Mod Note: thread was moved from Emotional Wellbeing after post #3}

April21, Start looking then... at least then you would be moving on your terms and schedule. Get hit with an eviction and 30 days to be out and you don't have something already lined up and it could be bad for you.

Point made. Regardless if it's her house I still deserve respect, I work hard and have never disrespected anyone in my life. She's never acted like this before. We are all stressed out about the situation, but throwing things at me and calling me names, will not be tolerated no matter who you are, and it certianlly won't help the situation at hand.

That is not a correct assumption... Respect is earned, It's not a birthright... if you get it... consider yourself lucky. Take that to heart or you are going to find yourself in one conflict after another the rest of your adult life.
You are entitled to Life, liberty and the pursuit of happiness... nowhere in the Bill of rights is respect mentioned.

Got it. Thanks. I'm still a little upset because I'm such a nice person all the way around, and for this to happen, on top of everything else, it's a little nerve wrecking. I'm emotionally drained, but again thank you for the insight. You were very helpful. Have a great evening!

Life, liberty and the pursuit of happiness isn't mentioned in the Bill of Rights either. In fact it is a very common misconception that Americans are entitled to it. The fact is that the phrase is mentioned in the Declaration of Independence. It was used to justify what was, essentially, the illegal act of rebellion. But these, supposedly, inalienable rights were not mentioned anywhere in the Constitution which is the true law of the land.

To April,
By the way, you should be happy the police didn't come. Since its her house, the likelihood is that the police would have removed you.

You too... I wanted to mention that because it's that mindset that gets so many young guys into trouble and then prison (women too) or even worse, dead in some neighborhoods... besides... it sets a bar that's so high that finding happiness in your daily life will be so much harder to achieve.

Neither are Life, liberty and the pursuit of happiness mentioned in the Bill of Rights. :)
Oh. ScottGem beat me to it.
