Hi Tax experts
I started my OPT from Feb 20th 2006 and started working in the same university as a Research Fellow after completing my MS while on F1. Now the payroll says that I need to pay for my FICA as I am a LEgal Temporary Resident. What does that mean ? I have presently began my H1 from Feb 19th 2007 and I know I am under FICA now.
Please let me know whether I needed to pay for my FICA all of 2006 under OPT?

How many years have you been on F1?

Regardless of how long you were on F-1, the day you converted to H-1 is the day you definitely become liable to pay FICA taxes.

If you entered the U.S. on a F-1 visa on or before 31 Dec 2001, you should have else been liable for FICA taxes for all of 2006 as well.
