View Full Version : Custody/ visitation case against convicted felon

I am currently process of starting a case for child custody and visitation for my 2 year old son. The father abandoned me when I was 8 months pregnant for another women. He on the birth cirtificate but that all. He would rarely come and see my son and he doesn't pay child support although its court ordered. The father pops up when he feels like it and he demands to see him and sometimes threatens with taking him I don't let him see him. His father has done absolutley nothing for my son. Its been me financially support him and taking responsibility for this child. He is also a conivicted felon. He was arrested for burglary and petite theft. Right its been a constant battle . I'm unsure of what to do about visitation. I haven't filed the case yet? What rights do I have as far as letting him see my son. I try to not let him take my son anywhere but he's been threatening with coming to my hom. I tried getting a restraining order but no luck because him threatening to make my son is not enuough to get the order in place. What should I do.

If there is a current visitation agreement with the court, that is the court order you are suppose to follow, his paying or not paying support is not connected to this.

If you want to lower his days of visitation or to make it supervised ( or try for it) then you file a motion to modify the current order.
