Hello,
I am a condominium owner and also hold a high position in our condo association. Several years ago our building sustained damage due to negligent construction on an adjacent property. After several years we have finally received our settlement and are in the beginning stages of repairing our building. It appears that some foundation work needs to be done and the only way for the repairs to be made is through my apartment. I have a duplex unit and the basement serves as both my living room and home office. The work is estimated to run approximately 2.5 months. From what I understand the floor will have to be torn up, the ceiling needs to come down, etc. I will obviously need to be relocated for the duration of the repairs. My questions are these:
1) As my apartment will be completely unusable, can I make the condo board pay for my moving expenses and relocation costs (ie - rental or hotel)?
2) I'm sure the repairs are going to cause more damage to my unit (tape lines/floor boards popping/dry wall cracks/etc.). Is the condo association under any obligation to remedy these problems when they occur?
I understand these repairs have to completed for the benefit of the entire building; I'm just concerned that most of the burden falls on me.
Any help or information is greatly appreciated.
