I am a tenant on a lease that is signed by the owner of the residents daughter. However, she is the poa of his assets as he is in a nursing home. I pay 600 a month which includes all utilities. I was informed that due to her fathers medical bills that she could not make any profit on the house as medicare could take the house. I was just giving a 3 day notice to evict due to non payment as I found out that there is no home owners insurance on the residence and therefor I agreed to pay the utilities. Well the homeowner just passed away and I got a letter giving me 7 days to move as the lease although singned by her was stated that is now a voided contract. It states that the lease is not terminated but I am to leave the residence. I am giving till July 6 to get out and all utilities will be shut off. She turned the cable off before I got the 3 day notice. I don't know what to do. I offered to pay the utilities and was told that she don't want my money but just wants me to leave. What do I do? I have a 5 yr old daughter and will be homeless.

No, the lease is still valid, if it was valid before his death, his estate and heirs are obligated to accept and honor the lease.

Also of course she could have made a profit off renting the house before, I don't even understand that lie at all.

But merely tell them that the lease is valid and that the 3 day notice is not valid. Remind them that you will expect them to honor the full terms of the lease.

I'm confused. How can she give you a 3 day pay or quit if you are paying the rent?

But Chuck is right. You have a lease and as long as you honor your end they have to honor their end. Also, tell them if they shut off the utilities you will sue them for an illegal eviction.

Also ANY question on law needs to include your general locale as laws vary by area.
