View Full Version : Can my husband adopt my daughter if her father is not in the picture

I live with my husband whom I met when my daughter was only 5 months old, she is now 6 years old, can my husband adopt her? Keeping in mind, her real father was out of the picture even way before she was born and never made an attempt to know her nor paid a single dime in child support. I do know of his wherabouts but would it make the adoption difficult.

Adoption is a legal process. A court has to approve the adoption. The court will require that the bio father be contacted and his permission obtained. If he refuses, you may still be able to get the adoption approved, it will just be a little harder. Since you really need to have an attorney prepare the adoption petition start shopping around for an attorney now.

As long as he will give his permission. Have you been to court, is there custody paper work in place ? Have you got a court order for support that he is not paying, not owinig or paying support if not the same if you have never filed for it.

Most bio fathers are happy to sign over rights to get out of paying support if they have been forced to pay and don't have any contact
