View Full Version : How to convey interest in mortgaged property

My daughter's husband and I are on the mortgage of a residential property in Okaloosa County Florida. My daughter had other obligations that did not allow her to purchase the house with him. My good credit was the reason I bought the house with him. He could not demonstrate the necessary income to purchase it on his own. I would like to insure that my daughter has my interest in the house now. How do I do that, although there is a mortgage on the house? Thanks.

You have to refinance. Th lender will probably need to approve any change in title

The names on the loan is not interest in the property, it is obligation to pay.
Whose names are on the deed ?

Wow, I was in Destin and Niceville just a few minutes ago. Work for a law firm that litigates foreclosure there and in other counties all the time. Small world, isn't it?
Anyway, you would convey your interest by deed. But that is a bad idea; it could be a violation of the terms of the mortgage. In theory, the bank could foreclose.
