View Full Version : Supervised visitation and missing visits

My husband and I have full custody of his 8 month old daughter. Her biological mother has 1 1/2 HR supervised visitation a week. Today she was over 15 minutes late which meant the visit was canceled. I left with baby and 20 minutes later the biological found me in the grocery store and attempted to approach me and baby.I asked her to leave, she asked if she could see her. I told her I'd call the cops if she got any closer and I left the store. The biological is on felony probation for child endangerment and multiple drug charges. Is their anything I can do to ensure the court gets note of this besides informing the social worker who does visitation? The only way she could have found us was by following me. I didn't want to cause a scene so I left but that is harassment considering she's not supposed to have ant contact with me should or can I still inform her probation officer or the police?

Who is to supervise the scheduled supervised visitation? If the mother is to have no contact with you, how is the scheduled visitation supposed to work?
If she violated a no-contact order, sure; report her if you feel you must.

What's wrong with informing the social worker and probation officer? They should report it to the court.

Next the child's father has full custody, you as the step mother has no legal rights, so please word this correctly.
Where are you meeting at, I assume the visitation is at some visitation center ? Since she can not be around you, you cannot be the one to supervise the visit legally ?
Also what is the rule on he time for visits/ do you only have to wait for 15 min at where ever the visit is ?

The visits are done at a Foster and adoption agency appointed by the courts and supervised by a social worker. I arrive to visit 15 minutes before scheduled visit and she is supposed to arrive promptly on time. If she's 15 minutes late the visit is automatically cancelled. There is no contact allowed between her and child without a social worker present.

She has a history of neglect and abuse and has lost two children permanently to CPS. The baby has been in our full care since she was 2 weeks old. I also want to know if I can get parental rights and adopt her without her mothers permission. I love her as if she is my own and I know that I can, have, and will continue to provide a safe loving and secure home for her.

You need the approval of both birth parents in order to adopt the child UNLESS their parental rights are terminated by the Court system. That does not appear to have happened.

Was this an isolated incident? If not, you may be able you get her rights terminated. You need a local attorney who knows the local courts to be able to give you a better idea of your chances.
