My 6 year old son's father left us when my son was 2 1/2 years old... I've gotten a little over 600$ total from him in this entire time... I do have Child Support of Florida pursuing him... however he works under the table now(which I have pictures of him working on his Facebook page)... anyways Child Support said they can't do anything about that. All they said was that his license is now being suspended and the next step will be a warrant issued. ~~ Getting to the point, we haven't seen him in years... he never takes my son and is not involved at all... but refuses to take any phone calls and will not respond to my emails asking him to sign over his rights... Is there ANYTHING I can do? I am afraid (God Forbid) if something happens to me, that my son would go to my ex and not be able to stay with my now fiancé, the only father he knows, and his brother(my son from my current relationship). My fiancé will adopt... but we can't do it without my ex signing over rights... HELP :-(

Hate to tell you... but you are asking for something that will be almost impossible to accomplish. And win or lose.. its going to be damned expensive.

You are putting the cart before the horse. You will not get his rights terminated. So stop wasting your time.

What you need to do is wait until you are married and/or fulfill the requirements for step parent adoption in Florida. Once you have done this, get an attorney and file a petition for adoption. Part of that petition will be termination of the bio father's rights. If the bio father will not agree, you can fight on the basis of his non involvement and probably win. But without the adoption as part of the package you won't win.

If the bio father just ignores the requests to relinquish the court will issue a TPR to clear the way for adoption. But again without the adoption it doesn't happen.

I will add, that even if the father were to agree to relinquish his rights, it still won't happen without the adoption. And if he is contacted (by your attorney since he ignores you) and told his support obligation will end with the adoption he should be willing to sign.
