I was a pedestrian at a large wharehouse store and I was hit by a chevy truck that was driven by an employee of the store. I was so shook up that I did not get any witnesses phone numbers at the time and know the store is saying that it was my fault for not getting out of the way of the truck fast enough. The driver an employee is saying that he did not know that he hit me. I called the police and filed a report and now the store is refusing to pay for my medical bills. Is it my word against the employees or do I have to prove he hit me in some way besides the medical issues. I did go to the emergency room at the hospital but due to a previous injury to my neck and lower back 10 years ago they did not do much and it was a low impact injury that made my neck snap back and re-injured it. Can I sue a big store and win?

You can sue, but I don't see that you have any proof. By leaving the scene without calling the police or reporting the incident to the store you have nothing to back up your story. You could have been hit by anyone anywhere.

You can hire an attorney to subpoena the store's video if the area was covered by a camera. But if nothing shows, you will be out the money.

Tough case, you needed to have stayed at the scene and got a police report. Did you go into the store as soon as it happened and file a report with them also ?

By the way, if the employee was not on the clock, driving his personal vehicle, then the store has no liability.
