View Full Version : Divorce filed in germany but marriage in america

I have a question. My fiancee' is german and still legally married america the marriage was never put on record here in germany. She is trying to get divorced from her husband who was highly abusive etc they've been separated for 3 years. She filed the papers through a german lawyer here to file papers through the state of Georgia for the divorce. Because of her being married in america but not being a legal citizen there just on a travelers visa would it even be a valid marriage. Also he said he was never served with divorce papers and he's been known to move around and avoid the situation. Does he have to sign those papers to legally make it a official divorce here in germany ? Also isn't there a 1 year rule of separation in germany or the states if someone has been separated for x amount of time it's a legal separation ?

He's married in the USA.. its a legal and valid marriage in Gernamy as a result. You have ot wait unitl she's officially legally divorced.
