View Full Version : Ex is trying to get support even though I have the kids

I'm at a loss here and need advice... Divorced about 10 years ago in Colorado. Our two kids live with me (mom). I moved to Arizona, he moved to Utah. He doesn't pay support very often. I just work hard to support kids. Teenage daughter goes to try living at dads house. She hates it, but he wouldn't let her come back. She runs away (back to me) after a year and refuses to live with him. In the meantime, he has already requested a modification. He states he makes 6000 per year (he has made a career out of raising foster kids, which is not reportable income). I dispute modification, arguing his income, the fact neither of us live in Colorado, therefore no jurisdiction, and that my daught doesn't live there. Colorado agrees they don't have jurisdiction, but tries to "close" the case by denying my dispute and move forward with the mod where I am ordered to pay him... still no order signed by judge though. Ex tries to open case in UT with no success. He then tries another county in Colorado... and according to the letter saying I need to make payments to him, he succeeded. In the meantime, I opened a support case in Arizona. I DO NOT want to pay him. They will garnish my wages (cause I do have a job). I support the kids on my own. He owes back support, plus was able to adopt and does not have custody, but I PAY HIM? Frustrated...

How can the child support agencies / courts allow this?

You respond to the court in CO that a) another CO court has already indicated they don't have jurisdiction, b) you were awarded custody in the divorce and that has never changed and c) you have filed a case in AZ where you and the children reside.

Include documentation of this in your response to the letter sent from the CO court.

Also get a letter from the AZ court that they have jurisdiction and present it to your job, in case they receive a garnishment order.
