View Full Version : What legal rights does an unmarried father have in regards to his biological son?

My son is in a situation with the mother of his1 year old son. He is the stay at home parent & his been since the mother went back to work. He takes good care of his son & his girlfriends' 2 children. He loves all the kids but now his girlfriend has decided she's not happy & wants my son to leave. He is listed on the birth certificate as the father of his son & wants to know if he does leave can he take his son with him? He does;nt want to leave & especially doesn't want to leave the other kids without someone to care for them. What are his rights in this matter? He lives in pa. any advice would be welcome.

His rights? The same as the mothers are... he can go to court... ask for and be granted full custody or anything up to it.
Unless the child has been adopted out... at which time and only then would his rights end.
