My wife received transfer orders to cali. And due to step son receiving testing for special ed we decided not to separate to boys and allowe them to continue school in tx. Is that child abandonment?

NO, but she is not raising them, it would or could be grounds for the bio father to ask the courts to modify the custody of the child back to him.

Is she coming back to TX every weekend ? If so she could argue she is traveling out of town during the week for work.

I will assume the bio father is causing trouble, since the child is not living with the mother.

Please clarify.

Your wife is planning on moving from Texas to California. Are you going too?

The two of you decided that your children would remain in Texas while one or both of you go to Calfornia? Are you just going to pack up and leave, expecting the boys to fend for themselves? Yes, that might be considered abandonment. How old are they?

But I'm guessing my interpretation of what you wrote might not be the true picture.
