I am in the middle of a divorce and my soon to be exwife is looking for child support. We have two children one tha tha I am the father of and one that I have rasied from since she we about 6 months. I have 50/50 visitation of both. While she is trying to use the one child as a source of income she is not taking into account that I am supporting her biological daughter 50% of the time. Can I ask the court for consideration in this case ?

You can ask the Court for anything you think is appropriate. Does she also get support from the bio father?

Yes she gets support from the bio father. We are in California

She can't get support from both of you. What you have paid so far will be considered household support. You can still raise the subject but I think what's done is done. I know this is a hard right now (never easy when a marriage breaks up) but what has happened is out of your reach.

Note: If its not child support or spousal support then it would be called "family support". Its an inclusive term and is also treated differently then child support. Child support is NOT tax deductable but if the court papers state "family support" then those payments would be deductable on your taxes and are to be included in the taxes of the recipient.
