Hi,

My dad has a house in DC and for the moment he is renting it, I would like to move in the house once my fiancé has her green card ( for the moment we live in Paris), when we decide to move back to the US I would like to evict the tenant, this is what the law says : Landlord or Owner's Personal Use: Your
Landlord must give you at least 90 days notice if the landlord or owner of your apartment wants to live in your apartment. You cannot be evicted if the landlord's friend wants to live in the apartment ….. ”
I am the son of the owner, not a friend! But close Family : Is that a good enough reason to evict the tenant without any justifications if I want to move back in??

Can you please cite the ordinance or statute to which the source you quote refers? I suspect "friend" includes a son, but I would rather see the exact wording of the entire ordiance or statute.

Also, is there a lease involved, or is it a month-to-month situation? Normally, a month-to-month can be terminated, upon 30 days notice, for any reason. On the other hand, a lease cannot be terminated for any reason other than a breach on the part of the tenant. So there would have to be some particular law (to which you allude) which is out of the ordinary, to break a lease.

I don't see anything about a landlord's being able to terminate a lease early for any reason, "friend" or otherwise.

Normally it only means the owner can move back in, other family members are not normally included in this. How long is their lease ?
