View Full Version : What is the maximum jail time for probation violation in tn

My husband was on probation for DUI. Next month supposedly case closed but he had an argument with his sister (this month) and she is charging him for domestic assault. He got locked up and I bailed him out for $500. Now, he got another warrant of arrest for violating his probation and we cannot afford to bail him out for $4000 so how many days or months he will be serving jail time? And if he will found guilty for domestic assault what will be his jail time? We cannot even afford to get a good lawyer.

The max time he can get, is the entire probation period, in jail, so if it was 1 year probation, he could serve 1 year in jail. That is not the norm, usually for first violation he is not going to get max. The fact they were going to even let him out on bond is a good thing, since they almost never bond out people on probation holds.

*** next a correction on terms.
His sister does not "charge" him, she just reports a crime, the DA decides if there is evidence to charge him. Next if he did it, ( you did not say if he was guilty or not) then he was suppose to be charged.


*** now my opinion or educated guess.
He will be held about 3 weeks till there is a hearing and most likely get about 1 to 3 months to serve for this. Most likely the DA will offer about the same time to serve and probation after that.

Now that is just my guess.
