Have you ever got a answer to this? Because I am needing the advise for my son? The mother dropped her off her apx 10days ago an was to return to get her the next day and can't even bother to call or come over to check on her 2yr old daughter. Her an my son never married thank god. He did however sign the b.c. and mother is drawing a ss ck on baby and foodstamps. When can he go to have her charged or to go for full custody> they just split up the first part of may this yr.

My son and his girlfriend split up the first part of may this yr. an she dropped baby off here apx 10 days ago and was coming to get her the next day. Haven't heard anything out of her except the txt mess. She sends to the girl he is seeing now threating her. And we live in small town she has not been in hosp or anything along those lines to make this acceptable. And she draws a disablity ck on baby since she was a premature baby plus is getting foodstamps and so forth on her. What are the rights of a unmarried father in Indiana alls he really has is his name on b.c and she has his last name. She is a little over 2yrs old now. Plus mom still keeps baby in a pack and play and has never even got her a real bed. And when she dropped her off she had shoes that were a good 2 sizes to big . And winter nerborn an 3-6months clothing in bag. Its June!! and she wears appx. 12month clothing. Needless to say not enough diapers for 3 days let alone. And she got babies ck 2 days before she brought her and left her here. What are the rights of a unwed father that signed birth cert and gave baby his last name

This should be a new thread - your son should go to Family Court (or the Court that handles these things in your area) and request custody.

First its not a good idea to piggyback your question on another thread. This can lead to confusion. So I've moved your question to its own thread.

The previous poster didn't get answers because she never returned to provide the additional information we asked for, information you didn't provide either.

What do you think you can charge her with? However, he can go for full custody. He can go to Family Court and apply for full legal and physical custody. If he gets granted full custody, he can then apply for the SS benefits and food stamps, if he qualifies.

To my understanding of the abandonment laws, this is not abandonment. Abandonment is if the child is left alone, with no care, for an extended period. If the child was with you, the child was not abandoned.

I just read the second thread - if the child is being abused or neglected you need to call Child Protective Services. Someone needs to help this child.

He needs to go and file a motion for custody of the child at this point.
