I have sole physical and ex has visitation we share legal .he has extreme religious views. He lives in MN I am in Ne with my daughter for five years now my boyfriend babysits for me when I work also now my ex wants her to go to a private christian school and not practice Halloween, I want her to trick or treat and stay in her public school. He has a major past record but the court said anything prior to 5 years they do not look at. He also says I need to make up the time he has missed with his visitation due to work. Right now he is driving her back and forth every 5 days and she doesn't really want to keep going she said. Can I get sole physical and legal? What are my rights right now?

You can, of course, ask the court to modify the custody order to give you sole legal custody, and eliminate his visitaiton. But, on the basis of what you said, I don't see that happening simply because the two of you do not agree.

If he now shares legal custody, I would guess that he has the right to a say regarding which school to whicl she goes. If you are at an impasse, you should take the issue up with the court which entered the custody order. But I don't know that whether she participates in Halloween (unless it is during his visitation) is any of his business, frankly.
