My son who is now 8 years old has lived with me since me and his father broke up in 2005. I have all documetns to prove this. We were never married and he did sign the Parentage of Recognition form when he was born. I lived in Minnesota up until a year ago and now my son will be going to visit for the summer. We have never went to court for custody and I want to know if he tried to not return my son, Do I legally have physical and sole custody as the mother?

The other parent has exactly the same legal right to keep the kid as you have without a court ordered custody agreement to the contrary.
