Hi,

Does the statue of limitaion apply to the illegal transfer of stock. I referenced 439F.2d 1005 ( John F Harrell v. Loice S Allen and Katie M. Smith).

My grandfather's case was probated 1976 and I have become of age and I am wondering is there a legal remedy at this late stage in the game.

Thanks,

Peace

No. Probate was closed and the statute of limitations on fraud is not going to be more than 30 years.

Not all of us have a ready means of looking up case law. What is the ruling in the Harrell case? What state is it in which your grandmother's estate was probated? And when did you come of age?

But ScottGem is probably right. Assuming you were alive in '76, and had some beneficial right in the estate, it has been at least 16 years since you came of age. I can't imagine a SOL being that long.
