View Full Version : Can someone get child support from the stepparent if it is the only income?

My husband and I have been married for 21 years now we have 2 children of our on and a granddaughter. We have problems back in 2009, I found out he had an affair with a co-worker. She became pregnant and gave birth in Dec 2009. My husband and I worked out our problems and stayed together. The first year of my step son's life my husband kept trying to talk to her to get child support established. She would either blow him off about it or just flat out refuse. (made no sense). He also consulted an attorney during that time and his advice was to not to push it if she is allowing us to see him. Well of course we did not feel right about that. Well my husband quit his job in Jan 2011 and to our surprise he could not find a job. He decided to change his career and so he is now a college student once again. Now that he does not have a job she has brought up child support to him a few times. I am the only income, we live paycheck to paycheck, we don't have extra money for anything and we still have one child at home that we are responsible for,so in other words we are surviving not living! So what I need to know is in the state of ALABAMA can she go through DHR and file for child support and it be taken out of my check? I am just worried being the only income at the moment that if that happens we could possibly have to move in with family so we can afford it. We have told her several times also that if she needed us to pay for something for him to let us know, but she won't even let us know if he gets sick. I don't mind helping out where help is needed but I can't afford a big chunk of my paycheck missing.

No. Not anywhere, as far as I know. It's his child support obligation, not yours.
