If my ex was in the military for 20 years and we were married for the 20 years and got divorce. As a military sponse I would be entitled to 1/2 of the pension until I remarry. In our sitution we settled on him buying me out. He could keep all his pension and he would settle with paying me a certain amount. Since I was supported to him the whole time he thought it would be unfair for me not to be able to marry again and be happy. We have 2 children and so on that note I agree so it would be such a hard time for him I would wait until children were grown to collect. We both were trying to make it work. Since then however he has remarried and his new bride don't agree with our arrangement. So he has filed bankrupty to get out of paying me and it has worked for him. An in the divorce we attended to divide everything up 50/50 for the children. Medical, continuing education etc. I was planning on having the payout to help me with that children's education. Would I have a chance to have this modified if I would go back to court?
