My daughter and boyfriend purchased a house in Montana they are living in. The house is titled in his name only. They are not married except by common-law. Is there any way possible to get my daughters name placed on the title without refinancing the existing loan and incuring closing cost and with minimal if no money out of pocket?My daughter contacted the mortgage company and they told her they would have to refinance the house and with curent interest rates the payment would go up $100 a month.confused:

I'm not sure if the laws vary in different states, but I believe you can just have the house re-titled. There will be a fee, but not nearly as much as closing costs. She would want to contact the Recorder's Office in the county where she lives. They can tell her more about the fees and the procedure to get the house re-titled.

Also contact a title company, preferably whomever drew up the original documents for the purchase of the property. (She may want to start there instead of the Recorder's Office.)

Your daughter's boyfriend would have to prepare a deed from himself, as seller, to himself and your daughter, as buyers. Then the deed would have to be recorded in the county clerk or county register's office.

The best way to do this is to have an attorney or title agency take care of it. That way they'll know that it was done properly. However they should be aware that transferring title this way is most likely in violation of the mortgage on the property. Most mortgages have a "due on sale" clause which means that the entire loan is due if the mortgagee discovers that the property has been sold this way.
