We have a very complicated matter here. My boyfriend soon to be husband has custody of his 9 month old son. He got a 2 yr order of protection against his ex girlfriend where she isn't able to even see the baby. My question is can we take her rights away and I adopt the baby? We can not afford a lawyer so any help in doing this on our own would be appreciated. Thanks

The answer is probably no. You can't take the baby away from the mother without her permission. The only reason that might be allowed is if it can be proven she is totally unfit to be a mother. The fact that he got the order of protection could indicate that.

I would wait until you are married, then start adoption proceedings which would include asking the bio mother to relinquish her rights.
