View Full Version : How can I share custody of my nephew with his father

My nephew is having some trouble at home and in school and wants to come live with me. I live in the same state but different city from my brother. In order to enjoy my nephew in school, I would need some sort of legal rights.

My brother is willing to let my nephew live with me but does not want to give up parental rights. He has sole legal custody of my nephew (for 10+ years).

I have tried talking to a lawyer but he doesn't seem to understand (he thinks I just need to enroll my nephew in school in my town - but that sounds wrong to me).

What are my options (we both live in Massachusetts)?

Have your brother give you temporary guardianship. He can specify in the guardianship agreement that this is temporary and can be revoked at any time.

That should give you the ability to enroll him in school and approve medical care, but not interfere with his father's rights.
