Hi,I. Was a h2a visa worker from 2008 to 2011,and I was never told about taxe,I got married ,my bos put me as a 1099 worker,can the IRS back taxe me,

The IRS can do almost anything it wants... including that.

Smoothy is over-stating it somewhat, but the IRS (and the state where you live) can and WILL collect the back taxes owed; it is only a matter of time.

It would be best for you to just calculate the taxes, file them, then request a payment plan with the IRS and the state.

Many, if not MOST H-2A workers will not owe any federal income tax--- but they do need to file a return. Starting in 2011 employers were supposed to fild W-2 forms for H-2A workers--- but IRS has stated in writing that they would still accept 1099s for 2011--- for the 2012 tax year, employers must file Form W-2 for H-2 A workers. Bottom line--- generally (but not in every case) H-2A workers should not have to pay federal income tax--- but they must file a report if they had income.
