View Full Version : What do I do when child support levy my bank?

Hi, This situation is my fiance's. He has back child support and it's been added to his monthly child support payment. He pay's child support every month and never late. Next thing we know, Az child support took everything is his bank account and left $250. He has more than 5k in the bank. I don't know the laws and procedures here in Arizona but it's really freaking frustrating because we have 2 kids together and we we're trying to move houses. He tried to call the DCES but of course been put on hold forever, been transferred for so many times, and end up on a voicemail. Hopefully someone knows or can give me advice on what to do here... Thanks!

If his name is on the account... they CAN take it... because he hasn't been paying what he owed.
I'd recommend getting your own account without his name on it.. If you can prove how much of that you contributed to the account... you might be due some of it back... but you are going to have to prove it first... and that's going to take a lot of time.
They can also garish his paychecks too... so be prepared for that.
If he pays everything he owes when he owed it... there wouldn't be an arrears... if in fact he is current.. then you better hire a lawyer and let them deal with it for you.
