I have been charged with 2 counts of theft under $5000- I went into a store with my boyfriend he went his way and I went mine then we met up and left together. 2 months later the police come to my home and arrest me. It's two counts because we were in the store on two different occasions, (we have been in that store many times not just 2) anyway they say they found some empty boxes then reviewed their security tapes and they said it's us- I know 100% that I never took anything off their shelves and I never opened any boxes or took stuff out of their store. I don't know what the video shows but for sure it doesn't show me doing anything wrong. I also never saw him take anything either but I wasn't walking around with him the entire time either. What are my chances of being found not guilty? Am I likely to end up with a criminal record? I am not some young teen out shop lifting, I am over 40 and NEVER been in trouble in my life!

So did your boyfriend steal it or not, if he did, yes ( depending on where this is) if you were with them, and together you both can be held liable for the crime.

I am sorry, you left the store, went to your car, you would know if he had stolen something or not.( sorry your statement that you don't know if he stole or not, is hard for me to believe and I am sure no judge will believe it)

So you had better talk to the boyfriend and see if he stole it or not, I is obvious the police did a lot of research and investigation, since you were arrestsed after investigation over time.

While the tapes may not show you took anything as Chuck said, if you entered and left with your boyfriend then you may be held guilty by association.

I would get an attorney who can subpoena the video so you know what you are dealing with.
