My ex and I were never married and we have a daughter. He has never been in her life and cares nothing for her. My husband wants to adopt my daughter and I would like to know if we have to have my ex's permission? And my daughter was never legitimized.

This question has been often asked and answered in this forum. The court will require that the father be identified and his permission be solicited before it will grant an adoption.

Yes, and it makes it harder, since you have not had a DNA test done, it will have to be done, and since you have never forced him to pay child support, he has really no reason to want to be helpful.
But yes the attorney doing the paper work will contact him to get him to sign over his rights.
