We were given a notice by sheriff office that said we failed to pay rent on time and had 10 days to appeal with magistrate. We called landlord and they just want us out so we didn't call magistrate. My question is our 10 days are up on Saturday (today) could they serve us our 24 hr notice today since today is day10? Also could it happen on sun or mon since its memorial day? We had no signed lease because it was family.

ANY question on law needs to include your general locale as laws vary by area.

I doubt if the sheriff will do anything over the weekend.

But on Tuesday, you will probably be physically removed. What are you waiting for?

We are in blythewood sc. We aren't really waiting just have to get our stuff in storage and stay with someone. Trying to get the money.
We haven't found anywhere else to move.

This (http://statutes.laws.com/south-carolina/title-15) portion of the South Carolina Statutes is where it would probably be. It doesn't seem to say, but, in most places, if an act is to be done in so many days, if the deadline falls on a Sunday or Holiday, that day is excluded.

Some of the court marshalls work on Saturday but I have never seen a court that has them work on Sunday or holidays. Some that serve papers for a fee ( they only get paid when they serve) do papers on Sunday and holidays, but it is not normal.

I also have never seen an eviction done on a holiday either. I would say it is safe though Tuesday but it is a guess, and if the paper work was already done anything is possible,
