OK, so my fiancée is in jail for the stupidest ever... the "victim" in the situation got a 1 yr pfa today. We have a peliminary hearing coming up soon, I hired a lawyer for all the hearings... He was on high impact probation, and got charged with disorderly conduct, and simple assult. They are saying that he violated probation, and got a detainer put on him, but the "victim" might drop the charges. If the charges get dropped will his detainer automatically get lifted?? Please Help!

No... because once they are filed... (and if the DA doesn't think there is cause... they don't get filed if you want them to or not)... so they don't get dropped unless the DA wants them dropped. And once he's violated he sits in jail until his hearing on that anyway... there is no "oops. sorry" at the hearing they decide what to do in that situation.

The lawyer should have been able to tell you all of that however.
