View Full Version : Is the automatically renewing lease enforceable in PA

:D I live in Allegheny county PA. I didn't receive a new lease when it expired in Oct. 2006. I thought the terms were now month to month w/60day written notice from both parties if not renewing. I requested new paperwork assuring I was allowed to remain in the premise. :eek: I was stunned when I was told that the lease automatically renewed for another year when intent to vacate wasn't received. I was also told I wouldn't receive new paperwork unless the rent was increasing.:rolleyes: Is this enforceable. I now see it is listed on the lease. :mad: I do not wish to be bound for another entire year. I know to read it thoroughly next time. I read that in some states you must initial beside this clause and landlord must send notice that it is automatically renewing. I live in Allegheny county Pa and am not sure if this applies to me. :confused: I would like to present proof since I was totally not aware that it automatically renewed! A Pa Real Estate Code number would be helpful. Thanks to anyone who is able to assist in this matter. :)

Hello Rene:

It was in your lease. You signed it. I understand that you didn't know it was there, but your signature tells the court that you did.

Now, the automatic renewal might, in and of itself, be contrary to the PA landlord tenant statutes, although I cannot find any reference to it. The law is listed above in one of the sticky's at the top of this forum. Maybe you can find something in there.
