View Full Version : Ex wife ruining my credit by not paying house payments

I've talked to a lawyer and the clerk of courts along with the county recorder where my ex wife's house is located. We are both on the mortgage, she was ordered to pay the mortgage and I was free and clear of all debts. She was to refinance the house and after 6 years and having 4 people live there that have jobs, they have decided not to pay the house payment.

I have her in contempt of court, my question is, will she just be ordered to pay a fine along with the fees that I encountered or is their jail time? She also will not pay my fees so that will be another contempt of court? What penalties could she face?

I live in Ohio if that matters.

She is required to show cause why she should not be held in contempt of court? She can attempt to prove that she unable to pay the mortgage. If she can do that, she will not be held in contempt of court.

If, on the other hand, the court finds that she has the ability to pay it, the court can be creative. It (the judge) can impose a daily fine (for example) until she writes the check. Or it could put her in jail until she decides to do what she has been told to do.
