We bought our home in March of 2006. We are in a partially rural area. Our home on 5 acres has a well and leach field. I just got a call from the city sewer saying there is a sewer hook-up for our property down at the road and we owe 6 years of back sewer fees, interest, late charges and penalties. No one ever told us this. We knew there was an option in the area to use city sewer but we have the well and leach bed. City sewer says they found out about this in an audit.
We never received a billing or a call in all these years. How can we be responsible? I told them we will gladly sign up and pay moving forward. They say be in here with all of your money with 3 business days. Is this possible?

Where "down the road" how far from your property ? They have to bring the hook up, to my knowledge to your property, to have you hook up.

And I don't think they can change monthly fees for usage if you don't use it,

There are fee's to bring it to the property.

I would not accept this, and even offer to pay anything. I would deny owing it, and have a real estate attorney review it before I made another statement to anyone.

I agree with Fr_Chuck on this one. The city may be able to force Marlittle to hook up, but I doubt that it can charge him/her for a hookup it didn't insist upon by giving proper notice.
