View Full Version : ITIN for my Dependent Wife

Hi,

I came to US for the first time on Auguest 28th 2006. I am on L1 visa and I have my wife and Child along with me.

For IRS tax filing for 2006 , what is my status --Resideint Alien or Non Resident Alien ?

Do we (me and wife) need to file Jointly?

If yes while filing online , its asking for my wife's SSN no. Since she does not have an SSN , what should I fill that column.

I heard that I have to applay for the ITIN for my wife. Do I need to submit the W7 also along with the ITIN application.

You actually donot have to put her social security on the form just fill out a W-7 and mail it in because It is going to a different place not the actual IRS office. Ou also have to send the Birth Certificate and a valid identification along with the application. Everything has to be original not copies. The address to sent the application to is on the instructions sheet and make sure that you send you 1040 along with it or else they won't accept it.

The easiest way to get the ITIN is to go to your local IRS office (call first to make sure they can issue the ITIN) with your wife and child and THEIR PASSPORTS and ask for one. The IRS representatives will walk you through the process.

Then file your return jointly once you meet the Substantial Presence Test in 2007, which, for you, would be around May 20th.

If you are not going to be in the U.S. on 20 May 2007, then file as a non-resident alien.
