My baby's father was convicted in 2007 of 7 counts, 5 being armed robbery and 2 being with a weapon. My child is 8 weeks old and I do not feel comfortable sending him off with his father. He drinks a lot and has a recent traffic violation, 79/60. He repeatly tell his family that I have denied him the rights to see his son, this being the farthest thing from the truth. On any occasion that he has asked to see his son I have told him to come see him, we live with my parents. So, my question is, in the state of virginia will he be able to get custody

You can not require him to visit in your home, but he will have to take you to court to get his visits. Your actions could be considered denial if the home would be unfriendly toward him.

The court may order it to be supervised if they feel there is a risk, may require parenting classes or more. Often the supervision is by court appointed person.

But if there is no current proof of any threat, he may get regular visits.
