View Full Version : My fianc what's to adopt my daughter

My Fiancé and I are getting married and he wants to adopt my 9 month old daughter. We have been together since I was 2 months pregnant. The biological father was told when I was 2 weeks pregnant and shortly there after disappeared from my life. I never heard from him again until I contacted him a few weeks before I gave birth. He came to our house once to visit when she was 2 weeks old. I was willing to put his name on the birth certificate and have him come visit when he could and I asked him for child support. Since then he has never come to visit again, canceled last minute, did not respond to my phone calls and so on. I recently contacted him and told him that my fiancé wants to adopt my daughter and I was looking for permission from him. He said he could never do that. I asked him to then be a father and be involved in the child's life. He has made no indication that he is interested in this either. IN fact he said that I have not given him the chance to do so. Funny huh? Anyway the question is How do we go ahead with adoption? Can I put my fiancés name on the birth cert? How do I prove, if need be, that the bio father is unfit and that I have a man who is very willing and able? Please help, I only want what is best for my little girl and I found that for her!

Without his permission, its unlikley you can proceed with the adoption.
You don't ASK him for child support. You get a court to order it. Go to Family Court and find out what you need to do to petititon the court for support. I'll bet, when faced with going to court, I'll bet he will be happy to relinquish his rights.

Unfit deals a lot more with custody and visitation levels.
Go to court and sue him for child support ( which you need a child custody agreement in place with him. Since if he is the father, nothing is stoping him from picking up the child and just goind away, since he is the legal father also at this point and time
So once he gets his paycheck garnished for child support and knows he will be paying for 18 plus years often he is a lot more willing to sign over custody.
Without his persmission most likely they will not be able to adopt,
