My boyfriend is currently on two separate felony probations. He violated two weeks ago with a new felony that he isn't even guilty of!. his attorney is trying to get it dropped completley or at least to a misdemeanor. My question to everyone is how much time do you think he will receive from probation with it being his first violation. I also want to add that he did three years in prison almost a year ago... thanks!

I also want to add that he did three years in prison almost a year ago...thanks!He can get every minute of the time he would have had to serve had he NOT gotten probation on BOTH of whatever he got probation on. First violation means nothing... any violation is a violation. And the fact he isn't a first time offender means they are more likely to throw the book at him.
Even a misdemeanor can send him back to the big house.

Okay next question. If he receives two years in prison usually they only do four months on a year meaning he would only do eight months. Will he end up staying in prison longer since he's been there before?

He will stay there longer since he has already been there, also often if probation send you back, you go for the time they send you for for.

Thank you. This is going to be a long road. It would help if his probation officers would answer the phone! He definitley needs a paid attorney!
